1. General provisions

These Terms and Conditions of Sale and Purchase (the Contract) is a legally binding document which sets out the rights, obligations and responsibilities between the Buyer and the Seller in relation to the Buyer's purchase of Goods at the Online Shop.

 

2. The moment of conclusion of the sale and purchase agreement

The contract is deemed to be concluded from the moment the buyer creates a shopping cart at the e-shop and pays for the goods in part (advance payment) or in full.

 

3. Protection of the Buyer's data

 

All the information relating to personal data is collected in order to:

-          process customers’ orders;

-          solve problems related to the availability or delivery of goods;

-          fulfil other contractual obligations;

-          with the customer's consent, to inform by email or telephone about the latest news in the shop.

 

4. Rights of the Buyer

The Buyer shall have the right to purchase goods at the Shop in accordance with these Terms and Conditions.

The Buyer shall have the right to withdraw from the Contract concluded with the Seller by notifying the Seller at info@topbaterija.lt no later than within 30 (thirty) days from the date of delivery of the item. No questions or form filling! The money will be refunded to the Buyer's account.

If the buyer wants to return the product, the buyer shall pay the delivery costs.

The returned product must be securely packaged.

 

5. Obligations of the Buyer

The Buyer shall pay for and accept the goods in accordance with these Conditions.

The Buyer undertakes to keep the login data confidential and not to disclose it to third parties. The Buyer shall be liable for any acts of third parties that are committed by using the Buyer's login data.

If the details provided by the Buyer in the registration form change, the Buyer must update them.

When ordering the goods, the Buyer undertakes to specify the place of delivery of the goods and other data necessary for delivery of the goods.

 

6. Rights of the Seller

 

If the Buyer attempts to undermine the stability and security of the online shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer's access to the online shop immediately and without prior notice.

The Seller reserves the right to discontinue the provision of the Services, to modify the Shop or any part of it, in whole or in part, and to modify any of its contents, at any time and without notice to the Buyer.

The Seller shall have the right to cancel the Buyer's order without prior notice to the Buyer if the Buyer fails to pay for ordered goods within 3 (three) working days after receipt of the invoice for payment.

In the event of any uncertainty as to the information provided in the order, the Seller shall contact the Buyer by telephone using the telephone number specified in the order, at the latest on the next working day following the day on which the order was placed.

In such a case, the delivery period shall commence from the date when the Buyer was contacted.

The Seller shall have the right to cancel the Buyer's order without prior notice to the Buyer if the Seller is unable to contact the Buyer within 2 (two) working days.

The Seller has the right to extend the delivery date if this is due to circumstances beyond the Seller's control (e.g., manufacturer's out-of-stock stock, delay in delivery by the transport company, etc.). The Buyer shall be informed of this immediately by telephone or e-mail.

The Seller shall not be liable to compensate the Buyer for any direct or indirect loss resulting from:

1. Delayed delivery of goods;

2. For faulty goods. In the event of receipt of faulty goods, the Buyer must first inform the Seller immediately of the faulty goods. The return or exchange of the Goods shall be carried out in accordance with the procedure described in Clause 4 of the Purchasing Terms and Conditions.

If a system error causes an incorrect price for an item at the online shop, the seller has the full right to cancel the buyer's order after informing the buyer beforehand.

 

7. Obligations of the Seller

The Seller undertakes to enable the Buyer to use the services provided by the Shop under these Terms and Conditions.

The Seller undertakes to deliver the goods ordered and paid for by the Buyer to the address indicated by the Buyer.

If the Seller is unable to deliver the goods ordered to the Buyer due to important circumstances, the Seller undertakes to offer an analogous or, if possible, similar product. If the Buyer refuses to accept an analogous or similar product, the Seller undertakes to refund the Buyer the money paid within 7 (seven) working days, if payment has already been made.

 

8. Other conditions

These Terms and Conditions shall be governed by the laws of the Republic of Lithuania.

Any disagreements arising from the implementation of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach agreement, disagreements shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
